State-level BC Reservation
In Andhra Pradesh, the Sistakaranam caste was included in BC Group-D, Sl. No. 44 through G.O. Ms. No. 13 in 2009.
After the bifurcation of Andhra Pradesh, the KCR government in Telangana removed our community along with 25 other castes from the BC list, which also resulted in the loss of the Central OBC quota. Subsequently, through AISKA and SWA's persistent efforts, our community was re-included among 112 castes via G.O. No. 3.
NCBC Recommendation for Central OBC Inclusion
With both Telugu state governments under pressure from our organisation AISKA, the National Commission for Backward Classes (NCBC) submitted a recommendation to the Central Government on 28th November 2023, requesting the inclusion of five castes in the Central OBC list: Toorpu Kapu, Kalinga Vaishya, Sistakaranam, Sondi, and Arava. This is currently in process awaiting the Final Notification.
Currently, the Central Government provides reservations as follows: OBC – 27%, SC – 15%, ST – 7.5% (total 49.5%). The Supreme Court's Indira Sawhney judgment limits reservations to 50%, and the Mandal Commission recommended 27% for OBCs.
Although OBC population across the country exceeds 52% (as estimated by the Mandal Commission), only 27% reservation is provided. At present, approximately 120 castes across the country are ready to be added to the OBC list. If included, the OBC population would be recorded at around 65%.
This is why a national movement is underway under the leadership of Sri R. Krishnaiah, demanding a caste census and an increase in the 50% reservation cap. Our Sistakaranam community through AISKA is directly participating in this struggle.
Supreme Court's New Creamy Layer Ruling (March 11)
Until now, if parents' annual income exceeded ₹8 lakhs, the candidate was classified as "Creamy Layer" and denied OBC reservation.
The Supreme Court's new ruling states:
"Income alone cannot be the sole criterion. The employment status of parents (e.g., Class-I / Group-A officer, major businessman) combined with income/wealth must both be considered."
How Does This Affect Our Community?
Most in our community are small farmers, small employees, and private sector workers. Earlier, crossing ₹8 lakhs annual income immediately pushed one into the Creamy Layer. Now that job status must also be assessed, children of Group-B and Group-C employees stand a better chance of retaining reservation benefits.
However, the Central Government has informed that if this ruling is applied retrospectively, thousands of OBC candidates already selected in UPSC, NEET, JEE, and other jobs and awaiting postings would have their certificates invalidated. Hence, the Centre has requested the Supreme Court to apply the ruling only prospectively (from a future date), not retrospectively.
Key Action Points for Our Community
- As we are currently listed under BC-D and not yet in the Central OBC list, the Non-Creamy Layer (NCL) certificate must be renewed every year.
- The fight must not stop until the Final Notification for our community's inclusion in the Central OBC list is issued.
- If parents are Group-A / Class-I officers, there is now a higher likelihood that their children will fall under the Creamy Layer.
